<br />1.9 <br /> <br />STATE OF TEXAS <br /> <br />CITY OF SAN MARCOS <br /> <br />LEASE AND PROGRAMMING SERVICES AGREEMENT <br /> <br />This Agreement is made between the City of San Marcos (the "City"), a Texas <br />municipal corporation, 630 East Hopkins, San Marcos, Texas and Southside Community <br />Center, Inc. ("Southside") , a Texas nonprofit corporation, 518 S. Guadalupe, San Marcos <br />Texas, 78666 . <br /> <br />~ <br />I <br /> <br />1. AGREEMENTS BY SOUTHSIDE <br /> <br />Southside leases to the City the portion of the Senior Citizen Facility (the "Facility") <br />located at 500 Parker Drive, San Marcos, Texas depicted on the attached Exhibit A (the <br />"Leased Premises") for $1.00 per year. The Leased Premises includes the large room, <br />parlor, storage areas, kitchen, small office area and restrooms. Southside represents that <br />the Leased Premises are in compliance with the Americans with Disabilities Act and City <br />of San Marcos Building Code regulations and are fully accessible to persons with <br />disabilities. <br /> <br />Southside will provide the City with the following: <br /> <br />A. Use of a van and driver for transportation connected with the City's senior citizen <br />activities when not in use for Southside programs (when available funding is found). <br /> <br />B. Use of equipment already in the Facility such as furniture, kitchen appliances, arts <br />and crafts equipment and other miscellaneous equipment. <br /> <br />C. Notice of special events that will preempt the City's senior citizen weekday daytime <br />programming in the Leased Premises, at least three days in advance of the events. <br /> <br />Southside will manage and maintain all of the Facility not within the Leased Premises, <br />including the exterior of the building, the grounds, and sidewalks, parking areas and utility <br />facilities. <br /> <br />2. AGREEMENTS BY THE CITY <br /> <br />The City will provide services at the Facility as follows: <br /> <br />A. Schedule senior citizen activities which will take place in the Leased Premises <br />between the hours of 8:00 a.m.-4:00 p.m. Monday-Friday. The City may also schedule the <br />use of the Leased Premises for special events on weekends and evenings, with advance <br />notice to Southside . <br />
