ORDINANCE NO. 2003 - 28 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING THE ABANDONMENT <br />OF THE 500 BLOCK OF NORTH FREDERICKSBURG <br />STREET; APPROVING THE CONVEYANCE OF THIS TRACT <br />TO SOUTHWEST TEXAS STATE UNIVERSITY AND <br />AMERICAN CAMPUS (SWT II) LTD.; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE A DEED; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br /> 97. <br /> <br />o :x ~.~ <br /> <br />RECITALS: <br /> <br /> 1. On April 8, 2003, the City Planning and Zoning Commission conducted a <br />public hearing on the proposed abandonment of the 500 block of North Fredericksburg <br />Street, and voted unanimously to recommend approval of the proposal. <br /> <br /> 2. The City Council conducted a public hearing on the abandonment of this <br />portion of Fredericksburg Street on Apr±l 1~, ,2003. <br /> <br /> 3. The owners of the real property abutting this portion of Fredericksburg Street, <br />Southwest Texas State University and American Campus (SWT II), Ltd, have requested <br />and consented to this abandonment. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The abandonment of 500 block of North Fredericksburg Street, as <br />shown on the attached map, is approved. <br /> <br /> SECTION 2. The City Manager, Dan O'Leary, is authorized to execute the deed <br />attached to this ordinance conveying the portion of Fredericksburg Street described above <br />to Southwest Texas State University. <br /> <br /> SECTION 3. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Clerk will publish notice of its adoption in a newspaper of general <br />circulation in the City. <br /> <br />PASSED AND APPROVED on first reading on April 14, 2003. <br /> <br />PASSED AND APPROVED on second reading on April 28, 2003. <br /> <br />PASSED, APPROVED AND ADOPTED on May 28, 2003. <br /> <br /> <br />
