ORDINANCE NO. 2003 - 29 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING ARTICLE 6, HOST <br />RESPONSIBILITIES OF PARTIES 1N RESIDENTIAL AREAS, <br />OF CHAPTER 34, ENVIRONMENT, OF THE SAN MARCOS <br />CITY CODE, TO CLARIFY AND CORRECT <br />TERMINOLOGY; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />106. <br /> <br />RECITALS: <br /> <br /> 1. In 2002 the City Council found that loud noise m~d parties in residential areas of the City <br />disturb the residents, detrimentally affect the integrity and livability of the areas, and reduce property <br />values. <br /> <br /> 2. On March 4, 2002 the City Council passed ordinance 2002-23 regulating parties in <br />residential areas. <br /> <br /> 3. The experience of the city staff, including police, in enforcing the regulations has indicated <br />the need for certain changes to the current ordinance. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. Section 34.701 of the San Marcos City Code, is amended to as follows <br />(underlining indicates added text, str~kcthrcugh indicates deleted text): <br /> <br />Sec. 34.701. Definitions. <br /> <br />In this article: <br /> <br />Host means a person who invites or allows others to gather or remain at his residence, or at <br />a residence he has a lawfid right to occupy, for a party. <br /> <br />Party means a planned or unplanned gathering of people. <br /> <br />Residence means a dwelling unit in m~ apartment, towtthouse, duplex or other multi-family <br />residential structure, or a single-family residence. Residence includes the entire premises of <br />a residence, including the residence building, garage, carport, driveway and yard, and <br />adjacent common areas, parking areas, sidewalks and streets. <br /> <br />Residential area means an area: <br /> <br />(1) That is within a residential zoning district; or <br /> <br /> <br />
