1 ORDINANCE NO. 2007- 28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADOPTING A REVISED SECTOR ONE, TWO AND THREE PLAN; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. Section 3.1.1.1 of the San Marcos Land Development Code adopts the San Marcos Horizons City Master Plan as the master plan for the physical development of the City, and Section 3.1.1.3 of the City Land Development Code provides for the adoption of sector plans as appendices to the San Marcos Horizons City Master Plan. 2. Section 7.02 of the City Charter requires the City Planning and Zoning Commission to "perform an ongoing review of the city's master plan to include ... holding public hearings and making recommendations to the city council regarding updates to the land use ... [element] at least once every three years ". 3. The City Council adopted the Sector One Plan on September 8, 1997, and amended the Sector One Plan on September 13, 2004. 4. The City Council adopted the Sector Two Plan on December 15, 1997, and amended the Sector Two Plan on July 23, 2001. The City Council adopted the Sector Three Plan on January 22, 2001. The Sector Three Plan has not been amended since its adoption. 6. The Planning and Zoning Commission held a public hearing on a revised Sector One, Sector Two and Sector Three Plans on October 24, 2006, and voted on November 14, 2006 to recommend the adoption of a revised Sector One, a revised Sector Two and a Revised Sector Three Plan by the City Council. 7. The City Council conducted a public hearing on the adoption of the revised Sector One, Sector Two and Sector Three Plans on April 17, 2007. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Sector One Plan adopted by the City Council on September 8, 1997 is repealed, and the revised Sector One Plan attached to this ordinance is adopted. SECTION 2.
