ORDINANCE NO. 2003 - 34 <br /> <br />116 · <br /> <br /> 0~"< <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 14, BUILDINGS AND BUILDING <br />REGULATIONS, OF THE CITY OF SAN MARCOS CODE OF <br />ORDINANCES TO CLARIFY A REQUIREMENT FOR SERVICE ON THE <br />ELECTRICAL BOARD; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Section 14.321 of the City Code establishes requirements and qualifications for members of <br /> the Electrical Board. <br /> <br />Section 14.402(a), pertaining to qualification for a Master Electrician license, was amended by <br /> Ordinance 2002-20, March 4, 2002, to require the City to approve acceptance of <br /> standardized tests for a master electricians exam. <br /> <br />3. An amendment to Section 14.321 is necessary in order to conform with the changes made <br /> previously to 14.402(a). <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION 1: Section 14.321 of the San Marcos Code of Ordinances is amended as <br />follows funderlininq indicates added text, str!k, ethrcu~,h indicates deleted text): <br /> <br />Sec. 14.32t, Established; membership and terms. <br /> <br />(a) The electrical board is established. The board consists of six members, five of <br />whom have voting rights and three of whom constitute a quorum. One member will <br />be a representative of the electric utility department nominated by the electric utility <br />board and approved by the city council. Two members will be master electricians <br />who are licensed by the city and who obtained their licenses through testing i~ <br />approved by the city. Two members may be either electricians or residents of the <br />city. The sixth member will be appointed by the building official from the official's staff <br />and will have no voting rights. <br /> <br />(b) The voting members of the electrical board are appointed by the city council for <br />staggered terms of two years, three members being appointed in odd-numbered <br />years and two being appointed in even-numbered years. The board will elect a chair <br />from its voting membership. <br /> <br /> SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br /> <br />SECTION 3.
