<br />INTERLOCAL AGREEMENT <br />CITY OF SAN MARCOS AND TEXAS STATE UNIVERSITY - SAN MARCOS <br />EDW ARDS AQUIFER RESEARCH AND DATA CENTER <br />WATER QUALITY ANAL YTlCAL SERVICES <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The CIty of San Marcos CCity") and Texas State University - San Marcos ("Texas <br />State"), Edwards Aquifer Research and Data Center CEARDC") enter into this Interlocal <br />Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas <br />Government Code, as amended. <br /> <br />Section 1. Scope of Services <br /> <br />Texas State agrees to provIde microbiological, liquid and solid analytical services for the <br />City of San Marcos on an as needed basis upon notification by the City in accordance with the <br />cost proposal attached to this Agreement as Attachment A. <br /> <br />Section 2. Compensation <br /> <br />The City agrees to pay Texas State a not to exceed total of $60,000.00 per year for Texas <br />State's satisfactory performance of its services under this Agreement. Texas State will bill the <br />City in accordance with the cost per sample rates included in Attachment A for services rendered <br />in the prevIOus month, and the City will pay for these services within 30 days of its receipt of <br />invoices from Texas State In the event that a rate increase is necessary, Texas State will notify <br />the City no later than 60 days prIor to the date rates are scheduled to increase. <br /> <br />The City and Texas State acknowledge that payments for services performed under this <br />agreement will be made from current revenues available to the City, and that the City's payment <br />under this Agreement is in an amount that fairly compensates Texas State for these services. <br /> <br />Section 3. Term <br /> <br />The term of this Agreement will commence on July I, 2007 and will continue until June <br />30,2011 unless terminated by either party in accordance WIth Section 4(g). <br /> <br />Section 4. Miscellaneous Provisions <br /> <br />a) Interlocal CooperatIOn, The CIty and Texas State agree to cooperate with each <br />other in good faith at all times during the term of this Agreement in order to achieve the purpose <br />and intent of this Agreement. Each party to this Agreement acknowledges and represents that <br />this Agreement has been executed by its duly authorized representative. <br /> <br />b) Entire Agreement, Amendments. Assignments: This Agreement contains the <br />entire agreement between the parties and supersedes all prior understandings and agreements <br />between the parties regarding such matters. This agreement may not be modified or amended <br /> <br />lnterlocal TxState. Analytical Testing 2007 <br />
