<br />40 <br /> <br />RESOLUTION 1997-. 71:) <br /> <br />R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DIRECTING THE CITY MANAGER TO NOTIFY <br />BROWNING-FERRIS, INC. OF THE CITY'S INTENTION NOT TO <br />RENEW THE SOLID WASTE AND RECYCLABLE MATERIALS <br />COLLECTION AND DISPOSAL CONTRACTS; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City's solid waste contract with Browning-Ferris, Inc. (BFI) expires on <br />August 31, 1997, but will automatically renew for a 5-year period unless the City provides <br />notice to BFI of its intention not to renew the agreement by March 3, 1997. <br /> <br />2. The City's recyclable materials contract with BFI expires on August 31, 1997, <br />and the City desires to provide notice to BFI of its intention not to renew this contract, along <br />with the notice provided for the solid waste contract. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Manager, Larry D. Gilley, is directed to notify BFI of the City's <br />intention not to renew the City's solid waste and recyclable materials contracts. <br /> <br />PART 2. The notice to be provided under this resolution is not to be construed as <br />an indication of the City's intention not to contract with BFI for solid waste and recyclable <br />materials services, but rather as a means of preserving the options available to the City for <br />the future provision of these services. <br /> <br />PART 3.
