A. The Developer will construct ali on-site public infrastructure required for the Property <br />under the Development Regulations, including but not limited to streets, sidewalks, drainage <br />improvements, and water and wastewater improvements, at the Developer's expense. The <br />Developer will submit construction plans and specifications to the City for approval. <br /> <br /> B. The Developer will construct the following off-site water and wastewater <br />improvements (the "Off-Site Improvements") at its expense, subject to reimbursement by the <br />City in accordance with Section 3.B and 3.C below. The cost of the Off-Site Improvements will <br />include engineering costs, construction costs, and easement costs. The Developer will ensure that <br />construction on the Off-Site Improvements is completed in conjunction with the platting of the <br />first subdivision to be developed within the Property. <br /> <br />1. Approximately 7,550 linear foot water line extension <br /> <br />2. Approximately 6,400 linear foot wastewater line extension <br /> <br /> C. The Developer will construct all public infrastructure for the Project in accordance <br />with the following: <br /> <br />1. All applicable City standards and specifications; <br />2. All applicable local, state and federal laws and regulations; <br />3. Construction plans and specifications reviewed and approved by the City; and <br />4. The Developer will ensure that the construction is carried out under the direct <br /> supervision of a professional engineer registered in the State of Texas. <br /> <br /> C. The Developer will donate to the City a site of approximately one acre for the City's <br />construction of an elevated water storage tank, at a suitable location on the Prope~Xy mutually <br />agreed upon by the parties. This donation may be accomplished in com~ection with the <br />subdivision platting of a portion of the Property, or by separate instrument. The donation will be <br />completed no later than December 31, 2003. <br /> <br /> D. The Developer will donate approximately 67 acres of parkland to the City or Hays <br />County for a regional park at a suitable location on the Property mutually agreed upon by the <br />parties. The Developer will seek funding for improvements to this parkland through County bond <br />funds and matching grants. This donation may be accomplished in cormection with the <br />subdivision platting of portions of the Property, or by sepm'ate instrument. The donation will be <br />completed no later than June 30, 2008. <br /> <br /> E. The Developer will donate a mutually acceptable site or sites within the subdivision to <br />the San Marcos Consolidated Independent School District (the "School District") for an <br />elementary and an intermediate school at a suitable location or locations on the Property mutually <br />agreed upon by the Developer and the School District. The Developer will present written <br />evidence to the City no later than June 30, 2008 that the Developer has completed this donation. <br /> <br />2 <br /> <br /> <br />
