<br />- ) ¡oT <br /> <br />VOL 167PAGE287 <br /> <br />-10- . <br /> <br />and assigns, as part of the consideration, covenants and agrees as a covenant <br />running with the land that: (1) no person on the grounds of sex, race, creed, color, <br />or national origin shall be excluded from participation in, denied the benefits of, or <br />be otherwise subjected to discrimination in the use of the Leased Premises, (2) that <br />in the construction of any improvements on, over, or under the Leased Premises <br />and the furnishing of services, no person on the grounds of sex, race, creed, color, <br />or national origin shall be excluded from participation in, denied the benefits of, or <br />otherwise be subjected to discrimination, and (3) that the Lessees shall use the <br />premises in compliance with all other requirements imposed by or pursuant to 49 <br />CFR Part 21, Nondiscrimination in Federally Assisted Programs of the Department <br />of Transportation, as amended. <br /> <br />15.7 The Lessees assure that it will undertake an affirmative action program as required <br />by 14 CFR Part 152, Subpart E, to ensure that no person shall on the grounds of <br />race, creed, color, national origin, or sex be excluded from participating in any <br />employment activities covered in 14 CFR Part 152, Subpart E. The Lessees assure <br />that no person shall be excluded on these grounds from participating in or receiving <br />the services or benefits of any program or activity covered by this subpart. The <br />Lessees assure that they will require that their covered suborganizations provide <br />assurances to the Lessees that they similarly will undertak.e affirmative action <br />programs and that they will require assurances from their suborganizations, as <br />required by 14 CFR Part 152, Subpart E, to the same effect. <br /> <br />15.8 That in the event of breach of any of the preceding nondiscrimination covenants, <br />Lessor shall have the right to terminate the Lease and to reenter and repossess the <br />Leased Premises in accordance with Article 13. <br /> <br />15.9 During the time of war or national emergency, Lessor shall have the right to lease <br />the landing area or any part of the area to the United States Government for military <br />use, and, if a lease is executed, the provisiöns of this instrument insofar as they are <br />inconsistent with the provisions of the lease to the United States Government, shall <br />be suspended. <br /> <br />ARTICLE 16, <br />Miscellaneous <br /> <br />16.1 Whenever the singular number is used, the same shall include the plural, and the <br />neuter gender shall include the feminine and masculine genders. <br /> <br />16.2 If any clause or provision of this Lease is illegal, invalid or unenforceable under <br />present or future laws, the remainder of this Lease shall not be affected, and the <br />parties declare that this Lease would have been entered into without such <br />unenforceable portion. <br /> <br />16.3 This Lease may not be altered or amended, except by instrument in writing signed <br />by both parties. The terms, provisions, covenants and conditions contained in <br />this Lease shall apply to, inure to the benefit of, and be binding upon the parties, <br />and upon their respective successors in interest and legal representatives, except <br />--- as otherwise expresslY-provided. <br />! <br /> <br />16.4 The captions used in this Lease are for convenience only and do not in any way <br />limit or amplify the terms and provisions. <br /> <br />16.5 One or more waivers of any covenant, term or condition of this Lease by either <br />party shall not be deemed as a waiver by that party as to any subsequent similar <br />act or omission. <br /> <br />16.6 Whenever a period of time is prescribed for action to be taken by Lessor, Lessor <br />
