Regular Meeting <br /> <br />June 9, 2003 <br /> <br /> 135. <br />Page 5 <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Habingreither closed the public hearing. <br />Mr. Montoya moved for adoption and Ms. Narvaiz seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A 15.31 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 1600 BLOCK OF POST ROAD AS ~MF-3" <br />MULTI-FAMILY DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Ron Patterson stated he represents the Berrys and Royal <br />Apartments. He also stated the Planning and Zoning Commission voted 7-1-1 <br />for the approval of this zoning. No one else wished to speak, so Mayor <br />Habingreither closed the public hearing. Ms. Narvaiz moved for adoption <br />of the Zoning Ordinance and Mr. Taylor seconded the motion. On roll call <br />the following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Thomaides, Mihalkanin, Habingreither, Taylor and Diaz. <br /> <br />NAY: Montoya. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Habingreither introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider this Ordinance. <br />The caption reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING LOTS 1, 2, 3 <br />AND 4A, CHAMPIONS BUSINESS PARK, LOCATED IN THE 3300 BLOCK OF <br />INTERSTATE HIGHWAY 35 NORTH, AS KC" COMMERCIAL DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither introduced for consideration approval of minutes of <br />the Regular Meeting held May 28, 2003, approval of two Ordinances on <br />second reading, adoption of one Ordinance on third and final reading, <br />adoption of nine Resolutions, approval for use of General Fund Contingency <br />Funds in amount of $70,000.00 to repair property damages at the Municipal <br />Airport and Parks and Recreation facilities due to the severe thunderstorm <br />of June 2, 2003 and approval of Change in Services No. 1 in the amount of <br />$28,125.00 to the engineering contract with PBS & J regarding the <br />Wastewater Master Plan, on consensus. The Council removed Item 14, <br />adoption of an Ordinance on third and final reading, Items 22 and 23, <br />adoption of Resolutions, to be considered separately. Mr. Montoya moved <br />for approval of minutes of the Regular Meeting held May 28, 2003, approval <br /> <br /> <br />
