<br /> -, 151 <br /> RESOLUTION 1997 - 62R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> SAN MARCOS, TEXAS APPROVING THE TERMS AND <br /> CONDITIONS OF A LETTER OF AGREEMENT BETWEEN <br /> THE CITY AND THE UPPER SAN MARCOS WATERSHED <br /> RECLAMATION AND FLOOD CONTROL DISTRICT FOR <br /> ACCESS FROM A PUBLIC ROADWAY TO AN EASEMENT <br /> AREA OWNED BY THE DISTRICT; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE THE AGREEMENT; AND <br /> DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Upper San Marcos Watershed Reclamation and Flood Control District <br />("District") owns an easement in a tract of land adjacent to Section 6 of the Willow Creek <br />Estates. <br /> " <br />2. Currently the access to this easement area is across an easement through <br />private property in a flood-prone area. <br />3. The City is installing a wastewater line in the area of the District's easement <br />and the District has agreed to exchange their easement for this Agreement to allow them <br />access through a portion of the park area dedicated during the platting of Willow Creek <br />Estates. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The terms and conditions of the Letter of Agreement attached to this <br />resolution between the City and the District are approved. <br />PART 2. The execution of the Letter of Agreement by the City Manager, Larry <br />D. Gilley, is approved. <br />PART 3.
