<br />< <br />f -, l52 <br /> í THE CITY 0>' ! <br /> SA."í ~1ARCOS ¡ <br /> \; ',: i <br /> <br />f- April 29, 1997 <br />! <br />¡ <br />I <br />-- Bill Taylor <br /> General Manager <br /> Upper San Marcos Watershed, Reclamation <br /> and Flood Control District <br /> Post Office Box:1334 <br /> San Marcos, Texas 78667-1334 <br /> LETTER OF AGREEMENT <br /> Dear Mr. Taylor: . <br /> This letter will serve as an agreement between the Upper San Marcos 'vVatershed, <br /> Reclamation and Flood Control District ("District") and the City of San Marcos ("City") for <br /> access from a public roadway to an easement area owned by the District, across the <br /> portion of the Park Area located adjacent to Section 6 of Willow Creek Estates that is <br /> depicted on the attached map (the "Property"). The access will consist of entry, passing <br /> across, and the transport of persons, goods and materials across the Property for the <br />( purposes of inspection of the dam site, for any necessary maintenance of the dam, and for <br />I access to the dam in the event of an emergency. <br />! <br /> The parties agree as follows: <br /> 1. The City will provide access from the public roadway across the Property to the <br /> District's easement area. <br /> 2. The District will construct and maintain an improved roadway through th~ Property, <br /> and will notify adjacent property owners of the initial construction prior to the actual <br /> commencement of improvements. <br /> 3. The District will hold harmless, indemnify and defend the City and its officers, <br /> agents and employees from and against all liability claims related to the use of the <br /> Property by the District. <br /> City Hall. 630 East Hopkins.
