PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. On AprilS, 1997, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "PO" Pre- <br />Development District to "MF-2" Multi-family District (Medium Density) for a one acre tract <br />of property located in the 1400 Block of River Road near its intersection with State Highway <br />SO. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on April S, 1997 consider and vote to approve t~e request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 12th day of May, 1997, regarding <br />the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "PO" Pre-Development District to "MF-2" Multi-family District (Medium <br />Density): <br /> <br />Street address: 1400 Block of River River near its intersection with State <br />Highway SO <br /> <br />Size: One acre. <br /> <br />Legal description:, Lot 1, River View Acres, Section Two. <br /> <br /> <br />Deed or plat reference: Volume 7, page 25S, Hays County Plat Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City.
