Adoption of Rules. <br />(a) The On-site Sewage Facility Rules are adopted, and all officials and <br />employees of the city having duties under these Rules are authorized to perform those <br />duties. . <br />(b) It is unlawful for any person whQ owns, maintains or occupies any structure <br />discharging sewage into an on-site sewage facility within the corporate limits of the city <br />to fail or refuse to comply with the On-site Sewage Facility Rules. <br />(c) V. T. C.A. Health and Safety Code Chapter 366, On-Site Sewage Disposal <br />Systems, and all revisions or amendments, is adopted by reference. <br /> . . <br />(d) The provisions of this chapter apply within the corporate limits of the city, <br />unless a provision expressly provides otherwise. <br />Sec. 86.152. Sewer connection required. <br />(a) It is unlawful for any person to cause or allow the instalJation of an on-site <br />sewage facility on a tract of property when any part of the property is within 300 feet in <br />horizontal distance (measured on the closest practicable access route) of an existing <br />organized system. <br />(b) Whenever an organized system is developed or extended within 300 feet <br />in horizontal distance from a tract of property served by an on-site sewage facility, it is <br />unlawful for the owner or occupant of the property to fail or refuse to connect the uses <br />served by the on-site sewage facility to the organized system. <br />(c) It is a defense to prosecution of a person under subsection (a) or (b) that: <br /> (1) The person has received a written denial of service from the <br /> organized system; <br /> (2) The person has received a written determination from the organized <br /> system that it is not feasible for the person to conn~ct to the <br /> organized system; or <br /> (3) A sewer line connection to the organized system could not operate <br /> by gravity flow. <br />(d) Connection of uses to the organized system shall be made in the most direct <br />manner practicable, and a separate connection to the system is required for each <br />building. <br />(e) The owner of a tract of property is responsible for all costs of connecting the <br />property to the organized system. <br />(f) It is unlawful for any person to use or maintain a cesspool or pit privy. <br />Sec. 86.153 Duties and powers of the Department. <br />The Department is the designated representative for the enforcement of this <br />division within the city. The Department has the following duties and powers: <br />(1) To resolve any question regarding interpretation of the On-site Sewage ~ <br /> Facility Rules. <br /> 2 <br />
