<br /> \ <br /> :!!: è) ~~ <br />Q~ <:) - 19 <br /> - ~~ <br /> 0 - <br />tù~ 0 c::,= <br />~ifl N <:,;) <t:S <br /> t.J..I <:1) <br /> CI:I- <br /> ~ ç=c ORDINANCE 1997--2.6 <br />11.t-;2 ~ _b <br /> ~ '-'ë:3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING A 12.0 ACRE TRACT OF <br /> PROPERTY LOCATED IN THE 1200 BLOCK OF LEAH <br /> DRIVE NEAR ITS INTERSECTION WITH WONDER WORLD <br /> DRIVE FROM "MF-5" MULTI-FAMILY DWELLING DISTRICT <br />I (HIGH DENSITY), "C" COMMERCIAL DISTRICT AND "LB" <br /> LIMITED BUSINESS DISTRICT TO "C" COMMERCIAL <br /> DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br /> PROVIDING FOR PENAL TIES. <br /> RECITALS: <br /> 1. On April 22, 1997, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "MF-5" Multi- <br /> Family Dwelling District (High Density), "C" Commercial District and "LB" Limited Business <br /> District to "C" Commercial District for a 12.0 acre tract of property located in the 1200 <br /> Block of Leah Drive near its intersection with Wonder World Drive. <br /> 2. Subsequent to the public hearing on that date, the Ptanning and Zoning <br /> Commission did, on April 22, 1997 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 9th day of <br /> June , 1997, regarding the request. <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br />¡ 5. The City Council hereby finds and determines that the adoption of the following <br /> - ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "MF-5" Multi-Family Dwelling District (High Density), "C" Commercial <br /> District and "LB" Limited Business District to "C" Commercial District <br /> Street address: 1200 Block of Leah Drive near its intersection with Wonder <br /> World Drive <br /> Size: 12.0 acres. <br /> Legal description: J.M. Veramendi Survey; a metes and bounds description is <br /> attached as Exhibit A. <br /> Deed or plat reference: Volume 263, page 522, Hays County Deed Records. <br />I <br /> <br />¡ SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br /> Plan is revised to conform to this zoning map amendment. <br /> SECTION 3. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br />
