<br />, . <br /> <br />80 <br /> <br /> <br /> <br />AGREEMENT BETWEEN <br />CITY OF SAN MARCOS <br />AND <br />GUADALUPE-BLANCO RIVER AUTHORITY <br /> <br /> <br />This Agreement Between City of San Marcos and Guadalupe-Blanco <br />River Authority (this "Agreement") is made and entered into as of <br />the 1st day of July, 1997, by and between the CITY OF SAN MARCOS, <br />I TEXAS (the "City"), a home rule city and municipal corporation of <br />the State of Texas situated in Hays and Caldwell Counties, Texas, <br />. organized and operating under the provisions of its home rule <br />charter and the Constitution and laws of the State of Texas, and <br />the GUADALUPE-BLANCO RIVER AUTHORITY ("GBRA"), a conservation and <br />reclamation district and political subdivision of the State of <br />Texas created pursuant to Article XVI, Section 59 of the Texas <br />Constitution:by special act of the Legislature, formerly compiled <br />at Article 8280-106, Vernon's Annotated Civil Statutes. The City <br />and GBRA are referred to herein collectively as the "Parties," éind <br />separately as the "Party." <br /> <br />Recitals <br /> <br />The City and GBRA entered into an Interlocal ~greement dated <br />April 23, 1996, as amended (the "Interlocal Agreement"). The <br />Interlocal Agreement, was executed by the Parties for the purpose <br />of providing for the expeditious development of a regional surface <br />water supply project (the "San Marcos Regional Water Supply <br />Project," or the "Project"), to meet future water needs and reduce <br />dependence on the Edwards Aquifer by providing an alternative <br />source of water to the City and surrounding areas in Hays, <br />Caldwell, Guadalupe and Travis Counties, Texas. This Agreement <br />sets forth terms and conditions agreed upon by the City and GBRA <br />¡ relating to the planning, development, design, financing, <br />¡ construction, ownership, operation and management of the Project. <br /> <br />GBRA holds the right to store water in and use water from <br />Canyon Reservoir under Certificate of Adjudication No. 18-2074C. <br />The City and GBRA have entered into a "Raw Water Contract" dated <br />October 10, 1989, pursuant to which GBRA agrees to supply to the <br />City up to 5,000 acre-feet per year of stored water from Canyon <br />Reservoir ("Canyon Lake Water"). This Agreement sets forth terms <br />and conditions agreed upon by the City and GBRA relating to the <br />diversion, conveyance and treatment of the Canyon Lake Water to be <br />supplied to the City. <br /> <br />The City is willing to acquire and construct water treatment <br />facilities to treat raw water for municipal use by the Parties and <br />their respective customers as contemplated herein, and is willing <br />to provide the necessary funds through the issuance of bonds. The <br />Parties have agreed that the water treatment facilities should be <br />operated and maintained as provided herein. <br />
