<br />bi s: r- 00, <br />a- ~8 <br />í' "~ 'g: ~ æ ll7 <br />i¡ ìJ>- c ,., LJ.J ~ <br />'S ë:5 r-'. a::: , c. <br />/::- -..;)"" <br /> <br />\~ ~ ~~ ORDINANCE 1997- 29 - <br />L' ~ ~o <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 1.54 ACRE TRACT OF <br />PROPERTY LOCATED IN THE 2200 BLOCK OF LEAH <br />AVENUE NEAR ITS INTERSECTION WITH WONDER <br />WORLD DRIVE FROM "MF-5" MULTI-FAMILY DWELLING' <br />DISTRICT (HIGH DENSITY) TO "C" COMMERCIAL <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On June 10, 1997, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "MF-5" Multi- <br />Family Dwelling District (High Density) to "C" Commercial District for a 1.54 acre tract of <br />property located in the 200 Block of Leah Avenue near its intersection with Wonder World <br />Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on J,une 10, 1997 consider and vote to approve the request, and has <br />recommended that the request be'approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 28th day of <br />July ,1997, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "MF-5" Multi-Family Dwelling District (High Density) to "C" Commercial <br />District: <br /> <br />Street address: 2200 Block of Leah Avenue near its intersection with Wonder <br />World Drive. <br /> <br />Size: 1.54 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 263, page 522, Hays County Deed Records. <br /> <br /> <br />¡ SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City.
