OF SAID BONDS; PROVIDING FOR THE SECURITY FOR AND PAYMENT Q ~ ~ ~ ~ OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE W ¿; a:: !:Ë â: OFFICIAL STATElYŒNT; ENACTING OTHER PROVISIONS RELATING TO THE =.J'~I C\.J &3 ~ SUBJECT; At'ID DECLARING At'f EMERGENCY -1- ., -1 C/J "- 1J.;~' ::J j::: Q .- "":) .::- \.u Z3t3 WHEREAS, this City Council (the "City Council"), by resolution adopted on May 19, 1997, directed publication of notice of the intention of the City of San Marcos, Texas (the "City") to issue not to exceed 52,500,000 waterworks and sewer system revenue bonds of the City for the purposes set forth in such notice; WHEREAS, such notice was published in the marmer and to the extent required by law; WHEREAS, there has not been filed I,vith the City Secretary or any other office of the City a petition protesting the issuance of such revenue bonds and requesting an election on same; and WHEREAS, it is affirmatively found and determined that the City is authorized to proceed with the issuance and sale of such revenue bonds as authorized by the laws of the State of Texas, including, particularly, Tex. Rev. Civ. Stat. Ann. arts. 2368a and 1111, et seq.; Now, Therefore . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: ARTICLE I DEFINITIONS AND OTHER PRELIMINARY MATTERS Section 1.01. Defmitions. - Unless othenvise expressly provided or unless the context clearly requires otherwise, in this Ordinance the following terms shall have the meanings specified below: "Additional Parity Obligations" means those obligations the City reserves the right to issue on a parity I"ith the Bonds, herein authorized in accordance I,vith the terms and conditions prescribed in Section 9.01 hereof. "Bond" means any of the Bonds. "Bonds" means the City's bonds entitled "City of San Marcos, Texas, Waterworks and -Sewer System Revenue Bonds, Series 1997" authorized to be issued by Section 3.01 of this Ordinance. "Closing Date" means the date of the initial delivery of and payment for the Bonds.
