RECITALS: 1. The City Council, in Ordinance 1993-10, reorganized the City's building construction ordinances, and repealed ordinance provisions for the testing and licensing of mechanical contractors by the City. 2. The City has continued, however, to renew mechanical contractor licenses since Ordinance 1993-10 passed. 3. The City would like to eliminate City licensing of mechanical contractors,' while providing an opportunity to persons who held mechanical contrac1or licenses when Ordinance 1993-10 took effect to obtain mechanical contractor licenses from the State of Texas. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Section 14.078 of the San Marcos City Code is amended, and .. Section 14.079 is added, as follows: . Sec. 14.078. Permit. A person applying for a mechanical permit must be: (1) A licensed air conditioning and refrigeration contractor under state law;-ðf (2) Exempt under state law from the licensing requirement: or:- .QL A licensed air conditioning and refrigeration contractor under section 14.079. Sec. 14.079. City license. (a) Each person holding a city air conditioning and refrigeration contractor license on March 4. 1993 is entitled to renewal of the license for the time period until December 31. 1998. upon timely submission of a renewal application under sub- section (b). (b) To obtain a renewal city license under subsection (a), a person must submit a completed renewal application. together with payment of a one-time renewal fee of $50.00. to the building official by July 31. 1997. ~ SECTION 2. The issuance by the Building Inspection Division of renewal City air I conditioning and refrigeration contractor licenses between March 4, 1993 and the effective ! date of this ordinance is ratified. I ' ,- SECTION 3. From and after January 1, 1999, the amendments described in Section 1 of this ordinance shall be rescinded, so that Section 14.078 of the San Marcos City Code returns to its form prior to this ordinance, and Section 14.079 of the San Marcos City Code as described in Section 1 of this ordinance is repealed. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed.
