<br /> ) LZ JZ. <br /> Interruption of Service <br /> <br /> 1.4.24 In the event the collection and disposal of residential refuse or recyclable materials <br /> are interrupted for any reason within BFl's reasonable control for more than forty-eight (48) <br /> hours, the City will have the right to make temporary independent arrangements for <br /> continuing this service to its citizens to provide and protect the public health and safety. <br /> In the event of this type of interruption BF! will bear all expenses incurred for collection and <br /> disposal. <br /> --~ 1.4.25 Notwithstanding any other provision of this Contract, if the interruption in service <br /> mentioned in the preceding paragraph continues for a period of 10 days, the City has the <br /> right to immediately terminate this Contract and to seek any remedy provided by law. <br /> Natural Disaster <br /> 1.4.26 In the case of excessive amounts of refuse caused by a tornado, severe storm, <br /> high winds, flooding, hurricane, ice storm or similar natural occurrence, the City may <br /> dispose of the refuse in whatever manner it may elect; provided however, that the City will <br /> attempt in good faith to use BFI's facilities if they can be used at the same or lower cost <br /> than other methods available to the City. <br /> Place of Collection <br /> . <br /> 1.4.31 BFI understands that normal collection points for residential refuse and recyclable <br /> materials will be from the alley, except where curbside collection is in effect. <br /> Miscellaneous <br /> 1.4.32 BFI will discontinue collection services at any residential unit as set forth in a <br /> written notice sent to it by the City. Upon further notification by the City, BFI will resume <br /> collection on the next regularly scheduled collection day. The City will indemnify and hold <br /> BF! harmless from any claims, suits, damages, .liabilities or expenses (including but not <br /> limited to expenses of investigation and attorney's fees) resulting from BFl's discontinuing <br /> service at any location at the direction of the City. <br /> 1.4.33 BF! will have sole and exclusive right to provide collection and disposal of <br /> residential refuse and recyclable materials from residential units within the Contract area. <br /> BFI has the right of first refusal to the collection of all other wastes from residential units. <br /> 1.5 EDUCATION PROGRAM <br /> BFI will: <br /> 1.5.1 Be an integral part of a continuing City service to which the residents are <br /> accustomed and provide a high level of cooperation with the City and its citizens in carrying <br /> 12 <br />
