Q ~ <br />ii1.~ C\J ~ii ORDINANCE 1997- 41 <br /> <br />.- <br />C <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 8.18 ACRE TRACT OF <br />PROPERTY LOCATED OFF OF THE 300 BLOCK OF <br />WONDER WORLD DRIVE FROM "PD" PRE-DEVELOPMENT <br />DISTRICT TO "I" INDUSTRIAL DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On June 24, 1997, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "PD" Pre- <br />Development District to "I" Industrial District for a 8.18 acre tract of property located off of <br />the 300 block of Wonder World Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on June 24, 1997 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 25TH day of <br />AUGUST ,1997, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "PD" Pre-Development District to "I" Industrial District: <br /> <br />Street address: Off of the the 300 block of Wonder World Drive. <br /> <br />Size: 8.18 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 365, page 324, Hays County Deed Records. <br /> <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 25day of AUGUST ,1997, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />SEPTEMBER 8, 1997. <br />
