~ 26 :!1E, <S"' >- gJ t"\c... õ e:::: t.) u .¥ '- ::5 à; c> . -- þJo - u.J ?- ~ 0:::= U.'"b C\J fß~ W~ ~ ~; ORDINANCE 1997- 42 ~ ~a AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING AN 18.39 ACRE TRACT OF PROPERTY LOCATED OFF OF THE 200 AND 300 BLOCKS OF WONDER WORLD DRIVE FROM "R-2" SINGLE-FAMILY RESIDENTIAL DISTRICT (MEDIUM DENSITY) TO "MF-4" MULTI-FAMILY DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On June 24, 1997, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "R-2" Single- Family Residential District (Medium Density) to "MF-4" Multi-Family District (High Density) for an 18.39 acre tract of property located off of the 200 and 300 Blocks of Wonder World Drive. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on June 24, 1997 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 25TH day of AUGUST ,1997, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "R-2" Single-Family Residential District (Medium Density) to "MF-4" Multi- Family District (High Density): Street address: Off of the 200 and 300 blocks of Wonder World Drive. Size: 18.39 acres. Legal description: See the metes and bounds description attached as Exhibit A. Deed or plat reference: Volume 365, page 324, Hays County Deed Records. SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master Plan is revised to conform to this zoning map amendment. SECTION 3. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
