An increase in the residential solid waste collection rate under the City's new <br /> agreement with Browning-Ferris, Inc. makes necessary a corresponding increase in the <br /> City's solid waste collection rate charged to residents. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. Under Section 66.028 of the San Marcos City Code, the monthly <br /> charge for the collection of garbage and rubbish from each residential unit located in the <br /> city using bags and containers is set at $11.46. <br /> SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions <br /> in conflict with this ordinance are repealed. <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br /> SECTION 4. That this Ordinance shall apply to bills dated on and after the effective <br /> date of this ordinance. <br /> SECTION 5. This Ordinance will take effect 10 days after the date of its final <br /> passage, and the City Secretary will publish notice of its adoption in a newspaper of <br /> general circulation in the City. <br /> PASSED AND APPROVED on first reading July 28, 1997. <br /> PASSED AND APPROVED on second reading August 11, 1997. <br /> PASSED, APPROVED AND ADOPTED this 25th day of Augus t , <br /> 1997. <br /> f)&!~~ <br /> Billy G.
