<br /> 40 <br /> RESOLUTION 1997J.34R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br /> CONDITIONS OF A PROPOSED AMENDED LEASE <br /> AGREEMENT BETWEEN THE CITY AND THE GREATER <br /> SAN MARCOS YOUTH COUNCIL; WAIVING ALL BUILDING <br /> PERMIT AND IMPACT FEES; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE THE AMENDMENT, AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The Greater San Marcos Youth Council has requested additional space directly <br /> behind their current building for the purposes of constructing a family resource <br /> center. <br /> 2. The City is willing to lease the additional space to the Greater San Marcos Youth <br /> Council under the terms and conditions of the Amendment to Lease Agreement <br /> attached to this resolution. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The terms and conditions of the attached Amendment to Lease <br /> Agreement between the City and the Greater San Marcos Youth Council, are approved, <br /> subject to an easement for a sanitary sewer line being retained by the City. The actual <br /> metes and bounds of this easement will be furnished to the Greater San Marcos Youth <br /> Council, and made a part of the lease amendment when they are prepared. <br /> PART 2. All building, impact fees and other fees in connection with <br /> construction performed by or on behalf of the Greater San Marcos Youth Council are <br /> waived. <br /> PART 3, The City Manager, Larry D. Gilley, is authorized to execute the <br /> Lease Amendment. <br /> PART 4.
