<br /> (1) Be responsible for approving the annual budget for tourism <br /> promotion programs. <br /> (2) Advise the San Marcos Area Chamber of Commerce as to the <br /> hiring and firing of management level employees responsible <br /> for tourism promotion programs. <br /> (3) Develop guidelines regarding the process for allocation of hotel <br /> occupancy tax funds for the arts through the San Marcos Area <br /> Chamber of Commerce. <br /> (4) Have other duties and authority as described in contracts <br /> between the city and the San Marcos Area Chamber of <br /> Commerce for tourism promotion programs. <br /> SECTION 2. The initial voting member appointees to the Convention and Visitors <br /> Bureau Board will determine their terms of office by drawing lots. <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br /> SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 5. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 6.
