<br /> \" <br /> (J 50 <br /> [: <br /> ,-,- <br /> '..'. <br /> (\.J <br /> (l,., <br /> :;:::; <br /> <t <br /> ORDINANCE 1997- 48 <br /> - <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING CHAPTER 14, <br /> BUILDINGS AND BUILDING REGULATIONS, OF THE SAN <br /> MARCOS CITY CODE TO PROVIDE ADDITIONAL TIME FOR <br /> RENEWAL OF CITY MECHANICAL CONTRACTOR <br /> LICENSES; INCLUDING PROCEDURAL PROVISIONS; AND <br /> DECLARING AN EMERGENCY. <br /> RECITALS: <br /> 1. The City Council, in Ordinance 1997-.3A, provided for a one-time renewal of City <br /> mechanical contractor licenses, with a deadline for submission of renewal <br /> applications of July 31, 1997. <br /> 2. The City Council would like to provide additional time for submission of these <br /> renewal applications. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. S~ction 14.079 of the San Marcos City Code is amended as follows: <br /> Sec. 14.079. City license. <br /> (a) Each person holding a city air conditioning and refrigeration contractor <br /> license on March 4, 1993 is entitled to renewal of the license for a time period until <br /> December 31, 1998, upon timely submission of a renewal application under sub- <br /> section (b). <br /> (b) To obtain a renewal city license under subsection (a), a person must <br /> submit a completed renewal application, together with payment of a one-time <br /> renewal fee of $50.00, to the building official by July 31, 1997. <br /> SECTION 2. The issuance by the Building Inspection Division of renewal City air <br /> conditioning and refrigeration contractor licenses between March 4, 1993 and the effective <br /> date of this ordinance is ratified. <br /> SECTION 3. From and after January 1, 1999, Section 14.079 of the San Marcos <br /> City Code as described in Section 1 of this ordinance shall be repealed. <br /> SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions <br /> in conflict with this ordinance are repealed. <br /> SECTION 5. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 6. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br />
