(\.J (l,., :;:::; <t ORDINANCE 1997- 48 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, OF THE SAN MARCOS CITY CODE TO PROVIDE ADDITIONAL TIME FOR RENEWAL OF CITY MECHANICAL CONTRACTOR LICENSES; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. RECITALS: 1. The City Council, in Ordinance 1997-.3A, provided for a one-time renewal of City mechanical contractor licenses, with a deadline for submission of renewal applications of July 31, 1997. 2. The City Council would like to provide additional time for submission of these renewal applications. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. S~ction 14.079 of the San Marcos City Code is amended as follows: Sec. 14.079. City license. (a) Each person holding a city air conditioning and refrigeration contractor license on March 4, 1993 is entitled to renewal of the license for a time period until December 31, 1998, upon timely submission of a renewal application under sub- section (b). (b) To obtain a renewal city license under subsection (a), a person must submit a completed renewal application, together with payment of a one-time renewal fee of $50.00, to the building official by July 31, 1997. SECTION 2. The issuance by the Building Inspection Division of renewal City air conditioning and refrigeration contractor licenses between March 4, 1993 and the effective date of this ordinance is ratified. SECTION 3. From and after January 1, 1999, Section 14.079 of the San Marcos City Code as described in Section 1 of this ordinance shall be repealed. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 6. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion.
