<br />t"-' <br />G-" ~ 63 <br />~ ~ <br />!'- C!I:::.c <br />0 fd:J <br />c..!J (1)- <br />~ ¡::;, ORDINANCE 1997- 49 <br />æia <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0.29 ACRE TRACT OF <br />PROPERTY LOCATED AT 509 MILL STREET FROM "M" <br />SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br />BUSINESS DISTRICT TO "MR" MOBILE HOME AND <br />RESIDENTIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On July 8, 1997, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "M" Single-Family, <br />Duplex and Neighborhood Business District to "MR" Mobile Home and Residential District <br />for a 0.29 acre tract of property located at 509 Mill Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on July 8, 1997 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 8th day of <br />September , 1997, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "MR" <br />Mobile Home and Residential District: <br /> <br />Street address: 509 Mill Street. <br /> <br />Size: 0.29 acres. <br /> <br />Legal description: Lot 23, AM. Ramsay Addition. <br /> <br />Deed or plat reference: Volume 89, pages 477-479, Hays County Deed Records. <br /> <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this8thday of September, 1997, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />September 22, 1997 <br />
