Section 102.026 of the City Code adopts the San Marcos Horizons City <br />Master Plan as the master plan for the physical development of the City. <br /> <br />2. Section 102.027 of the City Code directs the Director of Planning and <br />Development Services to prepare neighborhood/sector plans for all areas within the City. <br /> <br />3. The Director has prepared a sector plan for Sector One of the City, and the <br />Planning and Zoning Commission has voted to recommend the adoption of the Sector One <br />Plan by the City Council. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Article 2, Master Plan, of Chapter 102, Planning, of the City Code is <br />amended by adding Section 102.029 to read as follows: <br /> <br />Sec. 102.029. Sector Plans. <br /> <br />(a) The following sector plans are adopted as an appendix to the San <br />Marcos Horizons City Master Plan: <br /> <br />(1) The Sector One Plan. <br /> <br />(b) The future land use plan contained in each of the sector plans <br />adopted in subsection (a) acts as an amendment to the future land <br />use plan of the City. <br /> <br />(c) Proposed thoroughfares contained in each of the sector plans <br />adopted in subsection (a) act as an amendment to the major <br />thoroughfare plan of the City. <br /> <br />(d) The sector plans shall be used by the Planning and Zoning <br />Commission and the City Council in guiding decisions regarding the <br />growth and development of the City. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final <br />
