~~ø u W "ü t""\ 0:::: :,l» ~ ~Jj IL~ !!::: ORDINANCE 1997---'lL ~ Q;lü AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, INCREASING WATER AND WASTEWATER RATES ESTABLISHED UNDER SECTIONS 86.231 AND 86.262, RESPECTIVELY, OF THE SAN MARCOS CITY CODE; AND INCLUDING PROCEDURAL PROVISIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The water rates established under Section 86.262 of the San Marcos City Code are amended to read as shown on the Exhibit A which is attached to and made a part of this ordinance for all purposes. SECTION 2. The wastewater rates established under Section 86.262 of the San Marcos City Code are amended to read as shown on the Exhibit B which is attached to and made a part of this ordinance for all purposes. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 6. This Ordinance will apply to all water and wastewater billings dated on and after October 1 1997, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
