<br /> 70 <br /> RESOLUTION 1997 - 136R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING AN INTERLOCAL COOPERATION CONTRACT <br /> BETWEEN THE CITY AND THE TEXAS DEPARTMENT OF PUBLIC <br /> SAFETY FOR IMPLEMENTATION OF THE PROGRAM TO DENY DRIVER <br /> LICENSE RENEWAL FOR FAILURE TO APPEAR VIOLATIONS; <br /> PROVIDING FOR THE CHARGING OF AN ADMINISTRATIVE FEE; <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT ON <br /> BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Senate Bill 1504, Vernon's Civil Statutes, Article 6687d, provides for political <br /> subdivisions to contract with the Texas Department of Public Safety (TDPS) to <br /> deny renewal of the driver licenses of persons charged with the offense of Failure <br /> to Appear (FT A). The program is designed to motivate persons cited for traffic <br /> violations to comply with their promise to appear in court. <br /> 2. The City desires to participate in this program through a contract with TDPS. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. The terms and conditions of the Interlocal Cooperation Contract <br /> between the City and the Texas Department of Public Safety, a copy of which is attached <br /> and incorporated, are approved. <br /> PART 2. An administrative fee of $30.00, for each applicable FTA offense <br /> reported under the program is approved. <br /> PART 3. The City Manager, Larry D. Gilley, Is authorized to execute the <br /> contracts on behalf of the City. <br /> PART 4. This Resolution shall be in full force and effect immediately from and <br /> after its passage. <br /> ADOPTED this the 8th day of September, 1997. <br /> PJ~~.~ <br /> Billy G.
