Certification <br /> The Outside Entity shall provide to the State forty-five (45) days prior to any construction <br /> contract let date, a certification that all right of way has been acquired, all environmental <br /> problems have been remediated, and all conflicting utilities have been adjusted to clear the <br /> proposed construction; if applicable. <br /> 5. Engineering Services <br /> A. The Outside Entity will prepare or cause to be prepared the engineering specifications, <br /> environmental assessment, and estimates necessary for the development of the <br /> Project. <br /> B. The Engineering plans shall be developed with the Outside Entity's forces or its <br /> consultant, in accordance with the Design Division Highways and Procedures Manual <br /> and the 1995 Standard Specifications for Construction and Maintenance of <br /> Highways. Streets. and Bridges Manual (Metric). <br /> <br /> C. The Outside Entity shall submit any completed engineering plans and environmental <br /> documents to the State for review and approval three months prior to anticipated bid <br /> letting. Should the State determine that revisions are required to the engineering <br /> plans or environmental documents, the Outside Entity shall make the necessary <br /> revisions. The State will not let the construction contract until the engineering plans <br /> and environmental documents have been approved by the State. <br /> 6. Construction Responsibilities <br /> If the project is approved, the State shall advertise for construction bids, issue bid proposals, <br /> receive and tabulate bids and award a contract for construction of the Project in accordance <br /> with procedures and applicable laws. Actual construction shall be performed by contract <br /> awarded by competitive bidding. <br /> 7. Maintenance Responsibilities <br /> Upon completion of the Project, the State will assume responsibility for the maintenance of <br /> the completed facilities within its jurisdiction. <br /> Page 10 of 10 <br />
