'51. <br />II' I "b ---' &3 tIS <br />imoII ¡ ~ .-- , CI) <br /> <br /> <br /> <br />_Jv') 0- 'S <br />wr' ~ 5B ORDINANCE 1997- 61 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0.3 ACRE TRACT OF <br />PROPERTY LOCATED AT 705 CHEATHAM STREET FROM <br />"R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW <br />DENSITY) TO "LB" LIMITED BUSINESS DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On August 12, 1997, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "R-1" Single- <br />Family Dwelling District (Low Density) to "LB" Limited Business District for a 0.3 acre tract <br />of property located at 705 Cheatham Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on August 12, 1997 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 13th day of <br />October , 1997, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "R-1" Single-Family Dwelling District (Low Density) to "LB" Limited <br />Business District: <br /> <br />Street address: 705 Cheatham Street <br /> <br />Size: 0.3 acres. <br /> <br />Legal description: Lot 1, Block 4 of the Rio Vista Addition. <br /> <br />Deed or plat reference: Volume 132, page 244, Hays County Deed Records. <br /> <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this13tkrlay of October ,1997, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br /> <br />October 27, 1997 <br />
