<br /> 28 <br /> RESOLUTION 1997-182 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AMENDMENT NO. 1 TO THE <br />DEVELOPMENT INCENTIVE AGREEMENT BETWEEN THE CITY AND <br />CELESTINO MENDEZ, JR. AND ROSE MENDEZ FOR A DEVELOPMENT <br />AT 1216 MARTIN LUTHER KING DRIVE; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THIS AMENDMENT ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On November 25, 1996 the City Council approved a Development Incentive <br />Agreement (the "Agreement") with Celestino Mendez, Jr. and Rose Mendez (the <br />"Developers") for a Project to be constructed at 1216 W. Martin Luther King Drive. <br />2. The Developers have requested an extension of time for the completion of <br />the Project. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Amendment No.1 to the Development Incentive <br />Agreement between the City and the Developers is approved. <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />Amendment on behalf of the City. <br />PART 3. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br /> ADOPTED this the 24tldayof November 1997. <br /> ~~~. ~ <br /> Billy G.
