ORDINANCE 1997- 71 '- i( AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, RECLASSIFYING ONE POLICE OFFICER POSITION TO A CORPORAL POSITION IN THE POLICE DEPARTMENT IN ACCORDANCE WITH SECTION 2.373 OF THE SAN MARCOS CITY CODE AND SECTION 143.021 OF THE LOCAL GOVERNMENT CODE; AMENDING THE TABLE OF POLICE POSITIONS MAINTAINED IN THE CITY SECRETARY'S OFFICE TO REFLECT THIS RECLASSIFICATION AND TO INCLUDE CHANGES MADE IN THE 1997-98 BUDGET; AND INCLUDING PROCEDURAL PROVISIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. One police officer position in the Police Department is reclassified to a corporal position in accordance with Section 2.373 of the San Marcos City Code and Section 143.021 of the Texas Local Government Code. SECTION 2. The table of positions for each Civil Service Classification in the Police and Fire Departments kept on file in the City Secretary's office is amended to read as follows to reflect the reclassification made in Section 1 above, and to include two police officer positions in the 1997-98 Budget: Classification Number of Positions POLICE DEPARTMENT Police Officer (including trainees) 35 Police Corporal 19 Police Sergeant 9 Police Captain 4 Assistant Chief of Police 1 FIRE DEPARTMENT Firefighters (including trainees) 9 Driver/Engineer 12 Fire Lieutenant 6 Fire Captain 3 Assistant Fire Chief 1 SECTION 3. The 1997-98 Budget of the City of San Marcos is amended as shown on the attached Exhibit A in order to reflect the reclassification made in Section 1 above. SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
