upon request, the City of San Marcos will furnish evidence to the parties hereby released of payment in full by the City of San Marcos of all expenses and bills; and (3) the City of San Marcos has not assigned, pledged or otherwise ïn any manner whatsoever, sold or transferred, either in writing or otherwise, any right, title, interest or claim which the City of San Marcos has or may have by reason of the accident described above or any matters arising out of or related thereto, except to its counsel named in this instrument. The City of San Marcos understands and agrees that this is a full satisfaction for all damages arising on account of the above described incident and that the City of San Marcos will receive no further sum or sums of money and the City of San Marcos agrees not to assert or prosecute any further claims or lawsuits therefor against anyone whomsoever, whether or not herein otherwise named, described or identified. Any and all claims against parties not specifically released herein, if any, are hereby assigned in full to the parties hereby released. The City of San Marcos expressly warrants and represents to the parties hereby released, as part of the consideration for the payment of the above mentioned sum of money, that before executing this instrument, the City of San Marcos has been fully infonued of its tenus, contents, conditions and effects; that in making this settlement no promise or representation of any kind has been made to the City of San Marcos by the parties hereby released or by anyone acting for them, except as is expressly stated in this instrument.
