<br /> including but not limited to all of the same arising out of or in any way connected with the
<br /> allegations, subject matter and/or transactions either set forth and/or described in the
<br /> "Whereas" paragraphs beginning on page one hereof, or in any way connected with the
<br /> claims made by one or more of CITY, whether such claims, etc. are accrued at this time
<br /> or whether arising or to arise in the future, of any character, for damages or expenses,
<br /> claims or injunction, as well as for past, present or future accrued or to be accrued liability
<br /> for cost of court, interest, penalties, exemplary damages or attorney's fees and all claims
<br /> and causes of action raised or that might have been raised by the CITY.
<br /> 5. A YS hereby releases, acquits, and discharges and does for A YS, and its
<br /> successors and assigns, release, acquit and forever discharge CITY, its successors, heirs,
<br /> assigns, employees, agents and independent contractors, from, and A YS agrees to
<br /> indemnify CITY from and against any claims arising or asserted hereafter, from or through
<br /> A YS relating to, any and all claims, demands, damages, actions, claims for relief or
<br /> causes of action whatsoever, including but not limited to all of the same arising out of or
<br /> in any way connected with the allegations, subject matter and/or transactions either set
<br /> forth and/or described in the "Whereas" paragraphs beginning on page one hereof, or in
<br /> any way connected with the claims made by one or more of A YS, its subcontractors, or
<br /> third parties claiming by or through AYS, whether such claims, etc. are accrued at this time
<br /> or whether arising or to arise in the future, of any character, for damages or expenses,
<br /> claims or injunction, as well as for past, present or future accrued or to be accrued liability
<br /> for cost of court, interest, penalties, exemplary damages or attorney's fees and all claims
<br /> and causes of action raised or that might have been raised by A YS.
<br /> 6. CITY, by the entry into this agreement with AYS, does not hereby admit any
<br /> of the alleged causes of action or claims alleged by one or more of AYS against CITY, or
