AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.188 ACRE TRACT OF PROPERTY LOCATED IN THE 500 BLOCK OF VALLEY STREET FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO "MR" MOBILE HOME AND RESIDENTIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. On October 28, 1997, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single- Family, Duplex and Neighborhood District to "MR" Mobile Home and Residential District for a 0.188 acre tract of property located in the 500 block of Valley Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on October 28, 1997 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 15th day of December , 1997, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "MR" Mobile Home and Residential District: Street address: 500 block of Valley Street. Size: 0.188 acres. Legal description: Portions of Lots 7 and 8 of Block 8, D.S. Combs Addition, a metes and bounds description of which is attached as Exhibit A. Plat reference: Volume 42, page 443, Hays County Deed Records Deed reference: Volume 1240, page 121, Hays County Deed Records. SECTION 2. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
