CODE BY ADOPTING THE SECTOR TWO PLAN; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />r <br /><5:1 õ' 6';: ~ 1. Section 102.026 of the City Code adopts the San Marcos Horizons City <br />g ~ ffi\ister Plan as the master plan for the physical development of the City. <br />- a::::: <br />~<.;> c..;) <br />".'.'.'.','.'..'..~ ¡; ~'S 2. ?ection 102.029 of the C~ty Cod~ provides for the adoption of sector plans <br />iLLtil Èãa;an appendix to the San Marcos Horizons City Master Plan. <br />~ Q¡,;¡.~ <br /> <br />3. The Director of Planning and Development Services has prepared a sector <br />plan for Sector Two of the City, and the Planning and Zoning Commission has voted to <br />recommend the adoption of the Sector Two Plan by the City Council. <br /> <br />4. The City Council has conducted a public hearing on the adoption of the <br />Sector Two Plan. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 1 02.029(a) of the City Code is amended as follows: <br /> <br />(a) The following sector plans are adopted as an appendix to the San <br />Marcos Horizons City Master Plan: <br /> <br />(1) The Sector One Plan. <br /> <br />(2) The Sector Two Plan <br /> <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading December 1, 1997. <br /> <br />PASSED AND APPROVED on second reading December 8, 1997. <br /> <br />PASSED, APPROVED AND ADOPTED December 15, 1997. <br /> <br />D~~~ <br />Billy G.
