<br /> , ;¡':;I+ <br /> .' ~ Section 3, To obtain prior service credit allowable under Section 1 . of this ordinance any <br /> employee entitled thereto shall file a detailed written statement of the service claimed with the City <br /> -fCleR() (Secretary) within one year from the effective date of this ordinance. <br /> Section 4. As soon as practicable after the employee has filed a claim the prior service <br /> credit under Section 853.303, Title 8 of the Government Code, the City (Clerl() (Personnel Officer) <br /> shall, if said officer determines that such service was performed as claimed, verify the prior service <br /> allowable (not exceeding six months) and the average monthly compensation paid the member during <br /> the period of probationary employment, and shall certify to the Board of Trustees of the System the <br /> creditable prior service approved, and the average monthly compensation paid to the person by the <br /> city during the period of probationary employment. <br /> -- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> I <br /> , Section 5. Authorization of Restricted Prior Service Credit. <br /> ¡ <br /> (a) On the terms and conditions set out in Sections 853.305 of Subtitle G of Title 8, Texas <br /> Government Code, as amended (hereinafter referred to as the IITMRS Act"), each member of the <br /> Texas Municipal Retirement System (hereinafter referred to as the "System") who is now or who <br /> hereafter becomes ~n. employee of this City shall receive restricted prior service credit for service <br /> previously performed as an employee of any of the entities described in said Section 853.305 provided <br /> that (1) the person does not otherwise have credited service in the System for that service, and (2) the <br /> service meets the requirements of said Section 853.305. <br /> (b) The service credit hereby granted may be used only to satisfy length-of-service <br /> requirements for retirement eligibility, has no. monetary value in computing the annuity payments <br /> allowable to the member, and may not be used in other computations, including computation of <br /> Updated Service Credits. <br /> (c) A member seeking to establish restricted prior service credit under this ordinance must <br /> take the action required under said Section 853.305 while still an employee of this City. <br /> Section 6. The importance of this ordinance creates an emergency and an imperative public <br /> necessity so that the provisions of the Charter requiring ordinances to be presented at three separate <br /> meetings and that no ordinance becomes effective until ten days after its final passage should be <br /> . suspended, and this ordinance shall become effective on the first day of February 1996, after <br /> publication of notice of its adoption in a newspaper of ge,neral circulation in the City. <br /> - <br /> Passed and approved this the 2 2nd day of ,Tann¡:¡ry ,19 9h' <br /> <br /> ATTEST: APPROVED: <br /> . / 'W~ lìffry~ ðl yJ ~'!J!~.~ <br /> City' ecretary or Cle'fk <br /> Janis K.
