<br /> 98 <br /> ~ <br /> I <br /> RESOLUTION 1996 - 37R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS APPROVING THE QUITCLAIM OF THE CITY'S INTEREST IN A <br /> 0.341 ACRE ELECTRIC LINE EASEMENT OVER AND ACROSS LOT 1, <br /> SECTION 5 OF INTERPARK EAST; AUTHORIZING THE CITY MANAGER <br /> TO EXECUTE A QUITCLAIM DEED; AND DECLARING AN EFFECTIVE <br /> DATE <br />~ <br /> RECITALS: <br /> 1. The City is the successor -in-interest to a power line easement granted by <br /> RAKOR, Inc. to the Lower Colorado River Authority recorded in Volume 391, Pages 723- <br /> 726 of the Hays County Deed Records and, in turn, conveyed to the City of San Marcos <br /> from the Lower Colorado River Authority in a deed recorded in Volume 634, Page 834 of <br /> the Hays County Deed Records. <br /> 2. The electric line easement crosses Lot 1, Section 5 of Interpark East. <br /> 3. The owner of the property, Sam G. Parnes, RAKOR, Inc., has requested the <br /> City to release a portion, approximately 0.341 acres, of the electric line easement, and has <br /> agreed to bear the expense of the relocation of an existing electric line outside of the <br /> easement. . <br /> 4. The City staff has determined that this portion of the easement is not needed <br /> for current or anticipated future needs of the Electric Utility Department. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. That the release by the City of a 0.341 acres portion of the electric line <br /> easement described in Recital 1 to the owner Sam G. Parnes, RAKOR, Inc. is approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is authorized to execute a <br /> Quitclaim Deed conveying to Sam G. Parnes, RAKOR, Inc., the easement described <br /> above. <br /> PART 3.
