Mr. Thomaides <br />asked with the cap and replace program whether a sign would have to be <br />removed to put up a new sign. Mr. James stated yes, if within the City <br />limits or within the ETJ. He also stated billboards will be allowed in <br />the proposed San Marcos Loop, unless the Council designates it as a scenic <br />route. Mr. Mihalkanin stated he feels signs should be allowed on Hwy. 123, <br />but not in residential areas. He requests the Planning and Development <br />Department provide a map where signs can be allowed. He also stated he <br />prefers the current language, and he feels the cap and replace program <br />should pertain to the whole City. Ms. Narvaiz stated she asked Mr. Mark <br />Taylor to provide language pertaining to amendments to change the areas <br />outside the IH35 corridor within which new off-premise signs can be <br />located. Mr. Taylor inquired whether residential areas are buffered by <br />commercial zoning. Mr. Mark Taylor stated the amendments for residential <br />areas are prohibited areas rather than protected areas. Mr. Mihalkanin <br />moved to amend Section 106.074(e) with the language Mr. Mark Taylor <br />provided on behalf of Ms. Narvaiz, except delete (E) and re-letter, and <br />Mr. Montoya seconded the motion, which passed unanimously. Mr. Mihalkanin <br />moved to amend 106.074 to delete (1) and Mayor Habingreither seconded the <br />motion. Mr. Mihalkanin stated this means it would include the IH35 <br />corridor. Mr. Thomaides inquired whether Section 2 included cap and <br />replace for IH35, can a billboard be taken down on IH35 and be replaced <br />with 2 smaller billboards in another location. Mr. James stated with the <br />amendment on the floor, it would not allow 1 sign to come down and be <br />replaced with 2 signs. Mr. Thomaides stated he is having trouble <br />supporting a cap and replace program. Mr. Taylor stated he asked Mr. Mark <br />Taylor to prepare wording regarding a cap and replace program for IH35. <br />Mr. Mihalkanin and Mayor Habingreither withdrew their motion and second. <br />Mr. Mihalkanin moved to amend Section 106.074 to add an (f)l-4 with the <br />language Mr. Mark Taylor provided on behalf of Mr. Taylor, and Mr. Taylor <br />seconded the motion. On roll call the following vote was recorded: <br /> <br />AYE: Thomaides, Mihalkanin, Habingreither, Montoya, Taylor and Diaz. <br /> <br />NAY: Narvaiz. <br /> <br />ABSTAIN: None. <br /> <br />The Council then voted for adoption of the Ordinance on third and final <br />reading.
