On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Thomaides, Mihalkanin, Habingreither, Montoya and Taylor. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Narvaiz and Diaz. <br /> <br />Mayor Pro Tem Montoya introduced for consideration Item 15, removed from <br />the consent agenda, approval of an Ordinance on second reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAROCS, TEXAS, <br />APPROVING THE RELEASE OF AN ELECTRIC UTILITY EASEMENT WITHIN TWO <br />TRACTS OF REAL PROPERTY OWNED BY AMERICAN CAMPUS (SWT II) LTD. IN THE <br />200 BLOCK OF LINDSEY STREET; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />A RELEASE OF EASEMENT; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on second reading and Mr. <br />Thomaides seconded the motion. Mr. Thomaides stated he is concerned with <br />the demolition of homes on Lindsey Street. Mr. O'Leary stated Southwest <br />Texas State University purchased these homes to demolish and replace with <br />a structure on the site. He stated the City no longer needs these <br />easements. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Thomaides, Montoya, Taylor and Diaz. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Habingreither and Mihalkanin disclosure affidavits-business <br /> entity filed). <br /> <br />Mayor Habingreither introduced for consideration Item 16, removed from the <br />consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REVISING AND UPDATING CHAPTER 18, ARTICLE 3, FOOD SERVICE <br />ESTABLISHMENTS, OF THE CITY CODE, INCREASING FEES AND SETTING NEW <br />FEES FOR FOOD ESTABLISHMENT PERMITS, INSPECTIONS, FOOD HANDLER CARDS <br />AND RELATED SERVICES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on second reading and <br />Mr. Taylor seconded the motion. Mark Brinkley, Director of Environmental <br />Health, stated this proposed Ordinance is amending the fees and adding a <br />new provision for vending machines. He stated the re-inspection fee <br />occurs when there is a problem with a business with high demerits or a new <br />business that says they are ready for inspection, but are not ready.
