(h ;z) The changing of an off-premises sign to an on-premises sign by a change in the copy, <br />except for messages advertising the sign for sale or lease, and the changing of an on-premises <br />sign to an off-premises sign requires a pen,nit. Except within the highway corridor, changed signs <br />shall comply with ali regulations pertaining to the new use of the signs. <br /> <br />(i) Off-premises sign registration. <br /> <br /> (1) A person who owns any off-premises sign within the ciW or its extraterritorial <br />iurisdiction shall file with the director a complete listing, on a registration form provided by the <br />director, of all off-premises signs o~vned by the person as required by this subsection. An initial <br />listing as of January 1. 2003 shall be filed by September 30, 2003. An updated listing as of <br />Janum3, 1. 2006 and each three year period thereafter must be filed with the director by February <br />1st of the applicable year. <br /> <br />(2) No fee is required in connection with the filing of a registration form. <br /> <br /> (3) It is unlawful for a person who owns an off-premises sign to fail to file a <br />complete registration form in a timely manner as required by subsection (a). A separate offense <br />is deemed to be committed for each sign ovmed by the person that is not properly registered, and <br />for each day a sign owned by the person is not properly registered. <br /> <br /> SECTION 3. Notwithstanding the September 30, 2003 deadline for the filing of initial <br />listings of off-premises signs under City Code Section 106.074(i)(3), no permit for a new or <br />restructured off-premises sign shall be issued to an applicant unless the applicant has submitted a <br />completed registration form. <br /> <br /> SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full rome if they can be given effect without the invalid portion. <br /> <br /> SECTION 5. All ordinances and resolutions or parts of ordinances or resolntions in cmfflict <br />with this ordinance are repealed. <br /> <br /> SECTION 6. Pray person violating any provision of this ordinance corm~aits a misdemeanor <br />and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. <br /> <br /> SECTION 7. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED AND APPROVED on first reading on June 9, 2003. <br /> <br />PASSED AND APPROVED on second reading on June 23, 2003. <br /> <br />PASSED, APPROVED AND ADOPTED on July 14, 2003. <br /> <br />S <br /> <br /> <br />
