JUL-H .,5-7 r I'--rJ. <br /> <br />That this Agreement is made and entered into on "this 25th day <br /> <br />of March, 1996, by and between the City of San Marcos, a <br /> <br />municipal corporation organized under the laws of the State of <br /> <br />Texas (hereinafter referred to as "City"), Elim Water Company, <br /> <br />Inc., a Texas Corporation (hereinafter referred to as "Elimlt) and <br /> <br />Reece and Beverly Morrison, as individual landowners (hereinafter <br /> <br />referred to as "Morrisonslt) for the following purposes and <br /> <br />consideration: <br /> <br />Whereas the Morrisons are owners of two tracts of land <br /> <br />legally described as follows: <br /> <br />~ <br />9.10 acres of land out of the J.M. Veramendi <br />Survey No. Two ( 2 ), in Hays County, Texas <br />being mpre particularly described by metes and <br />bounds in Attachment itA", to this Agreement. <br /> <br />10.58 acres of land out of the J.M. Veramendi <br />Survey No. Two ( 2 ), in Hays County, Texas, <br />being more particularly described by metes and <br />bounds in Attachment "B", to this Agreement. <br /> <br />--- <br /> <br />, Whereas Elim currently holqs n~~erous utility easements <br />i <br /> <br />covering the Morrisons' land. <br /> <br /> <br />Whereas the Morrisons desire to eliminate or consolidate as <br /> <br /> <br />many easements as possible that affect their property. <br /> <br /> <br />Whereas the City desires to expand transmission of water to <br /> <br /> <br />the area for the public safety, health and welfare and in so <br /> <br /> <br />proceeding needs a utility easement for the location of a <br /> <br /> <br />transmission main on the Morrisons' property. <br /> <br /> <br />In light of these facts, the Morrisons hereby agree to grant <br /> <br /> <br />in perpetuity, a water line easement and an access easement to <br /> <br /> <br />Elim, as dedicated in Attachment "C" and a public utility easement <br /> <br /> <br />and an access easement in perpetuity, to the City, as dedicated in <br /> <br />I Attachment liD". <br /> <br /> <br />-- In consideration for its water line easement and access <br /> <br /> <br />easement, Elim will return its interest in all previously acquired <br /> <br /> <br />easements across the Morrisons' property to the Morrisons through <br /> <br /> <br />a quitclaim deed in the form attached as Attachment ItE. II This <br /> <br /> <br />quitclaim deed will be signed by Elim within five (5) working days <br /> <br /> <br />after its water line relocation has been tested and approved by <br /> <br />OfAOAl PUBLIC RECORDS I l <br /> <br />'. ~oys County, Texas (jOA~ <br />
