-' '6Þ 2.3 The CITY will designate the City Engineer-as the CITY's representative to act in the CITY's behalf with respect to the Project. The CITY and/or such authorized representative will examine the documents submitted by the ENGINEER and will render responses pertaining thereto promptly and provide the ENGINEER with the requested data or information in CITY's possession relating to the Project. 2.4 The CITY will provide access to and make all necessary provisions for the ENGINEER to enter public and private property as required for the ENGINEER to perform its services under this Agreement. 2.5 The CITY will furnish all legal, accounting and insurance counseling services as may be necessary at any time for the Project, including such auditing services as the CITY may require to ascertain how or for what purposes the Contractor used the money paid by or on behalf of the CITY. 2.6 The CITY will furnish required information and will render responses and conduct its review of written materials as expeditiously as possible. 2.7 The CITY will pay all costs incident to obtaining bids or proposals from Contractors (e.g., legal notice requirements and the provision of the City facilities for pre-bid conferences) . ~ 2.8 The CITY will either direct the ENGINEER to perform any additional services necessary to complete the Project or will furnish those services itself. 2.9 CITY will bear all costs incident to this Article. 2.10 The CITY will provide its standard construction contract documents, which do not include plans or technical specifications, to the ENGINEER when the ENGINEER commences work on preparing the construction contract documents, Subsection 1.2.5. ARTICLE 3 CONSTRUCTION COST 3.1 DEFINITION 3.1.1 The construction cost will be the total cost or estimated cost to the CITY of all elements of the Project designed or specified by the ENGINEER. 3.1.2 The construction cost will include at current market rates, including a reasonable allowance for overhead and profit, the cost of any equipment which has been designed, specified, selected or specially provided for by the ENGINEER, except that used materials and equipment will be included as if purchased new for the Project.
