C.RA. to provide supervision and labor to replace Bank # 1 & Bank #2 distribution breakers, panels, disconnect switches, and buswork at San <br /> Marcos substation. <br /> 1. C - 1\.. to provide supervision and labor to install and remove a mobile transformer to perform diagnostic testing on T -1 & T - 2 transformers per <br /> attE lent' A', inspect T -1 & T - 2 Itcs per attachment' A', test alarms on T -1 & T - 2 transformers, diagnostic tests and inspection of T -1 & T - 2 total <br /> bre :1>, repair oil leaks on T-l transformer, inspect circuit switchers cs-4975 & cs-4985, and test T-l & T-2 relays and trip check at San Marcos <br /> substation. <br /> Materials to be provided as detailed in attachments 'B' and 'C'. <br /> TOTAL CONTRACT CHARGES NOT TO EXCEED $115,060.00 <br /> DESCR1PT.ION PRICE <br /> Upgrade distribution at San Marcos substation $85,545.12 <br /> Perform maintenance on Bank # 1 & Bank #2 at San Marcos substation $29,514.88 <br /> TOTAL $115,060.00 <br /> Contract terms: . <br /> The exact dates of work to be performed shall be agreed upon by both parties. Neither party will be liable for delays beyond its control. If the crews <br /> should be delayed in perfoITIÙng the work because of adverse events beyond LCRA's control, the work shall be rescheduled at a mutually <br /> convenient time. <br /> San Marcos Utilities will be billed for actual work performed with the total price for services not to exceed $115,060.00. Work may be performed in <br /> phases due to the unavailability of two reclosers which San Marcos Utility has purchased but will not have available during the initial phase of work. <br /> An invoice will be sent to customer within 30 days of work performed for each major phase. - <br /> AI :quest for additional work not covered by this contract will be priced at $40.00 per hour and additional material and transportation required <br /> Wl : priced at LCRA cost plus 15%. Any additional work requested shall be detailed and authorized by a representative of S.M.E.U. before work <br /> be <br /> LCRA shall perform the work in a safe and competent manner in compliance with LCRA's safety policy and with applicable Federal, state, and local <br /> laws and regulations. <br /> LCRA shall take reasonable measures to prevent damage to or loss of equipment worked on and adjacent property. LCRA shall repair or replace, at <br /> LCRA's option, any equipment or adjacent property that is damaged through negligence ofLCRA. LCRA shall not be responsible for repair or <br /> replacement of equipment or adjacent property damaged by others. <br /> LCRA shall not be responsible for security of the job site, street traffic safety, keeping out intruders, roping off work areas or other matters not <br /> directly related to the performance of the work. <br /> LCRA shall indemnify and hold Customer harmless trom any and all claims, causes of action, judgements, losses, damages and cost resulting for the <br /> injury or death of any person and for damage to any property that occurs during LCRA's on site performance of the work to the ex1ent that the injury, <br /> death or damage is caused by the negligence ofLCRA's employees. Customer shall similarly indemnifY LCRA with respect to negligence of <br /> Customer's employees. <br />
