The C.ïty Historic Preservation Commission has recommended that City Code <br /> Section 42.077 be amended to clarify notice requirements for applications for certificates <br /> of appropriateness. <br /> 2. The City Planning and Zoning Commission has recommended that the <br /> requirement in City Code Section 42.051 that one member of the Historic Preservation <br /> Commission also be a member of the Planning and Zoning Commission be deleted. <br /> . <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> SECTION 1. Section 42.051 of the San Marcos City Code is amended to read as <br /> follows: <br /> Sec. 42.051. Established; appointment; qualification of members. <br /> The historic preservation commission is established. The commission shall <br /> consist of seven persons, appointed' by the city council from the following <br /> sources: <br /> (1) One member shall be a resident of the city from the architecture or design <br /> field of expertise. <br /> (2) Three members shall be citizens of the city who have demonstrated an <br /> interest in the history of the city. <br /> (3) One member shall be a property owner or resident from the San Antonio <br /> historic district. <br /> (4) One member shall be a property owner or resident from the Belvin Street <br /> historic district. <br /> (5) One member shall be a property owner or business owner within the <br /> downtown historic district. <br /> SECTION 2. Section 42.077(a) of the San Marcos City Code is amended to read <br /> as follows: <br /> (a) At least 5 days before the commission meeting at which a certificate <br /> of appropriateness for a structure will be considered, written notice of the <br /> proposed certificate shall be sent by regular mail to the owner of the structure, <br /> the applicant, and each owner of real property within 200 feet of the property on <br /> which the structure is located, as indicated by the most recently approved tax <br /> roll. <br /> SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />
