<br /> 72 <br /> RESOLUTION -1996- 62 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, TERMINATING THE CITY'S LICENSE AGREEMENT WITH <br /> SOUTHWEST TEXAS STATE UNIVERSITY FOR THE USE OF CITY PARK <br /> PROPERTY ADJACENT TO THE UNIVERSITY'S CAMPUS; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> -- <br /> RECITALS: <br /> 1. The City has made available city park property for use as an athletic <br /> practice field by Southwest Texas State University (SWTSU), at no charge under a <br /> license agreement dated May 16, 1983 (the License). <br /> 2. The City has continuously honored this License, with mutual benefits <br /> accruing to both SWTSU and the City. <br /> . <br /> 3. The City has determined that a higher and better use now exists for the <br /> property covered by the License. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. The City elects to terminate. the License. <br /> PART 2. The Mayor and/or the City Manager, are authorized and directed to <br /> notify SWTSU of the termination of the License. <br /> PART 3.
