'- ;:; ORDINANCE 1 ~6- 28 <br />=~ ~~ -- <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0.321 ACRE TRACT OF <br />PROPERTY LOCATED AT 712 PEQUES STREET FROM "P" <br />PUBLIC DISTRICT TO "MF-2" MULTI-FAMILY DISTRICT, <br />(MEDIUM.. DENSITY); INCLUDING PROCEDURAL <br />- ~ PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On February 27, 1996, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "P" Public <br />District to "MF-2" Multi-Family District (Medium Density) for a 0.321 acre tract of property <br />located at 712 Peques Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on February 27, 1996 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br /> <br />. <br />3. The City Council held a public hearing on the 22nd day of <br />April ,1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />~- TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real property <br />which is presently zoned "P" Public District to "MF-2" Multi-Family District (Medium <br />Density): <br /> <br />Street address: 712 Peques Street <br /> <br />Size: 0.321 acres. <br /> <br />Legal description: See attached Exhibit A. <br /> <br />SECTION 2. That any person violating any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 22 day of April ,1996, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />May 13, 1996 . <br /> <br />Reconsidered yes no x <br />
