220. <br /> <br />RESOLUTION 2003- 112 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN EMERGENCY CONSTRUCTION CONTRACT <br />WITH DU-MOR ENTERPRISES, INC. FORTHE CHARLES AUSTIN DRIVE <br />EMERGENCY 12" WATERLINE REPLACEMENT PROJECT; APPROVING <br />THE CITY MANAGER'S EXECUTION OF CONTRACT DOCUMENTS ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. The City staff has recommended that the City execute a construction contract <br />with Du-Mor Enterprises, Inc. to relocate a conflicting and aging waterline on Charles <br />Austin Drive on an emergency basis in order to expedite the start of reconstruction of a <br />major arterial roadway to coincide with Southwest Texas State University's summer <br />sessions which will minimize construction/traffic hazards. <br /> <br /> 2. The City Council finds and determines that it is necessary to enter into this <br />construction contract on an emergency basis without formal competitive bidding in order <br />to preserve and protect the public health and safety of the City's residents. <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> PART 1. The award of an emergency contract to Du-Mor Enterprises, Inc. for <br />the Charles Austin Drive Emergency 12" Waterline Replacement Project in the amount of <br />$98,060.50 is approved. <br /> <br /> PART 2.
